Safety Advocates Call for Changes in Tire Recall System

Miami, FL (Law Firm Newswire) July 29, 2015 – Safety advocates are calling for electronic scanning of automobile tires as a way to ensure that recalled tires are actually taken off the road and off of store shelves.

According to estimates from federal regulators, between 62 and 80 percent of recalled tires are not actually taken out of circulation.

“There is no question that the tire recall system needs improvement,” said Jason Chalik, a prominent Florida personal injury attorney with Chalik & Chalik. “When defective tires under a recall continue to be sold, drivers are at risk of serious injury and even death from car accidents.”

In a July 21 conference call, safety advocates and representatives of the tire industry came to an agreement to support the installation of technology in tires that allows them to be scanned and tracked, such as radio frequency identification (RFID) chips. On the same day, the U.S. Senate was also moving forward with a transportation bill that includes a provision requiring independent tire dealers to register tires when they are sold and communicate that information to tire manufacturers. The Rubber Manufacturers Association supports mandatory tire registration, rather than the current system of voluntary registration.

The proposals for action came after tire maker Continental issued two recalls in July. Continental recalled 3,800 tires because of a risk of tread separation, and 8,500 tires due to risk of air pressure loss. The tires were sold as replacements only, and Continental said it was speaking to tire dealers to help identify people who bought the tires so they could be contacted. No injuries were reported.

“Anyone injured in a car accident resulting from faulty tires should consult with an experienced personal injury attorney,” said Chalik. “Manufacturers and dealers who sell defective tires need to be held accountable.”
